Terms of Service

1. Scope

These Terms of Service (hereinafter 'Terms') apply to all contracts between Angela Fueller, Ganghofer Strasse 5, 86836 Graben, Germany (hereinafter 'Provider') and the user (hereinafter 'Customer') regarding the use of the Messier76 platform.

Deviating, conflicting, or supplementary terms and conditions of the Customer shall only become part of the contract if and to the extent that the Provider has expressly agreed to their validity in writing.

2. Subject of Contract

The Provider provides the Customer with a web-based platform that includes the following services:

• Analysis of satellite data to monitor plant health
• Calculation of vegetation indices (NDVI, EVI, SAVI, etc.)
• Weather data and forecasts for agricultural areas
• Management of fields and zones
• Financial tracking and reporting
• Team collaboration and task management

The platform is currently in beta phase. The scope of functions may change and there may be limitations in availability.

3. Registration and User Account

Registration is required to use the platform. The Customer is obligated to provide truthful and complete information during registration.

The Customer is responsible for keeping their login credentials confidential. They are liable for all activities that take place under their account.

The Provider reserves the right to suspend or delete user accounts if these Terms are violated.

4. Usage Rights

The Provider grants the Customer a simple, non-transferable right to use the platform for the duration of the contract within the scope of these Terms.

The satellite data originates from the European Union's Copernicus programme and is subject to the Copernicus Data License. The Customer may only use this data within the scope of the license terms.

5. Customer Obligations

The Customer agrees to:

• Use the platform only for lawful purposes
• Not introduce malware or harmful code
• Not violate the rights of third parties
• Not perform automated access without prior permission
• Not overload or disrupt the platform

6. Prices and Payment

The current prices for the various subscription tiers are available on the website. All prices include statutory VAT.

Payment is made in advance for the respective billing period (monthly or annually).

In case of payment default, the Provider is entitled to suspend access to the platform.

7. Availability

The Provider strives for the highest possible availability of the platform. However, 100% availability cannot be guaranteed.

Maintenance work will be announced whenever possible. The Provider is not liable for outages due to force majeure or disruptions beyond their control.

8. Liability

The Provider is fully liable for intent and gross negligence as well as for damages resulting from injury to life, body, or health.

In case of slight negligence, the Provider is only liable for breach of essential contractual obligations. In this case, liability is limited to the foreseeable, contract-typical damage.

The satellite and analysis data is for informational purposes only. The Provider assumes no liability for decisions made based on this data.

9. Contract Duration and Termination

The contract is concluded for an indefinite period and can be terminated by either party with one month's notice to the end of the month.

The right to extraordinary termination for good cause remains unaffected.

After termination of the contract, the Customer's data will be deleted after a transition period of 30 days, unless legal retention obligations exist.

11. Changes to Terms

The Provider reserves the right to change these Terms with reasonable notice. Changes will be communicated to the Customer by email. If the Customer does not object within 30 days of receiving the notification, the amended Terms shall be deemed accepted.

12. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for all disputes arising from this contract is, to the extent permitted by law, the registered office of the Provider.

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
